Donation terms and conditions
How donations, recurring payments, refunds and fund reporting work.
Last updated: Working draft
This document is a working draft prepared for review by a lawyer before the website's public launch. It does not constitute legal advice.
Contents
1. Recipient of donations
Donations made through this website are received by ASOCIAȚIA IVACATERINA’S WAYMAKERS (the “Association”), a non-profit legal entity established under Romanian Government Ordinance no. 26/2000, tax identification code 50179280, with its registered office at Str. Dropiei nr. 2, sc. D, et. III, ap. 14, Timișoara, jud. Timiș.
A donation is a voluntary act with no consideration in return: we do not provide goods or services in exchange for it.
2. Use of funds
Funds are used solely for the Association's statutory purpose, in particular for:
- funding scientific research on SPG4;
- scientific collaboration with research institutions;
- supporting the patient community and families;
- public information and awareness;
- fundraising costs (for example, payment-processor fees) and the Association's operating costs.
The campaign target of €3,000,000 is a fundraising ambition, not the price of a treatment. If the target is not reached, or is exceeded, the funds raised are still used for the Association's statutory purpose, with public reporting.
Donations support research but do not guarantee any scientific or medical outcome and do not give access to treatments, clinical trials or any other benefit.
3. Ways to donate
3.1. Card payments
Online card payments are processed by Stripe (Stripe Payments Europe, Limited) through the secure Stripe Checkout page. Card details are entered directly with Stripe and do not reach the Association's servers. The donation is made in the currency shown on the payment page. Payment processors charge fees, which are usually deducted from the amount the Association receives.
3.2. Monthly recurring donations
Where this option is available, you may choose a monthly donation, charged automatically through Stripe every month until cancelled. You can cancel at any time by writing to contact@ivacaterina.org from the email address used for the donation; cancellation takes effect for future payments. Payments already made are not refunded, except in the situations described in section 6.
3.3. Bank transfer
You can donate by bank transfer to the Association's IBAN, shown on the Donate page, quoting the reference indicated there. Bank statement data is kept in the accounting records.
3.4. Bursa Binelui
Donations through the Bursa Binelui platform (operated by Banca Comercială Română) are processed under that platform's terms and conditions, and the Association receives from the platform the data provided for in those terms.
3.5. Other processors
We may later add other authorised payment processors (for example, NETOPIA Payments or EuPlătesc). The specific conditions will be published on this page.
4. Donation confirmation
After paying by card you will see a confirmation page; a confirmation may also be sent by email. It evidences receipt of the donation but does not, in itself, give you any tax benefit. For confirmation of a bank transfer, write to contact@ivacaterina.org.
5. Tax aspects
The information below is general, reflects the law as at the date of the last update and is not tax advice. We do not promise any tax benefit.
- Individuals in Romania. Donations made by individuals are not deductible from income tax. Sponsorship by people carrying out independent activities (for example, a PFA) is not deductible either.
- Redirecting 3.5% of income tax (Form 230). Individuals may redirect up to 3.5% of their annual income tax due but, starting with 2024 income, only from salary income. The amount can be paid to the Association only if it is entered in the Register of entities/religious units eligible for tax deductions (RUC) on the date of payment. The form is generally filed by 25 May of the year following the year in which the income was earned. The Association's current RUC status: being verified.
- Companies. Profit-tax payers may subtract sponsorship from the profit tax due, within the limits of Art. 25(4)(i) of the Romanian Fiscal Code (as at the last update, the lower of 0.75% of turnover and 20% of the profit tax due), only if the sponsorship is made under a written contract concluded under Law no. 32/1994 on sponsorship (stating its object, value and duration and the parties' rights and obligations), and only if the Association is entered in the RUC on the date the contract is concluded. Since 2024, microenterprises can no longer subtract sponsorship from microenterprise income tax. Please check the conditions with your company's accountant before concluding a sponsorship contract.
- Donors in other countries. The tax treatment depends on the law of your country of residence; we cannot guarantee that your donation is deductible.
6. Refunds (proposed policy)
You may request a refund of a donation made in error (wrong amount, duplicate payment or unauthorised use of your card) within 30 days of the payment date, by writing to contact@ivacaterina.org. Please state the date, amount, currency, payment method and, if you have it, the payment reference.
- We review each request and, if it is justified, refund the amount, usually through the same payment method.
- In case of unauthorised use of your card, please also notify the issuing bank. Your rights against your bank (for example, disputing a transaction) are not affected.
- Outside these situations, donations made are not refunded, because the funds are allocated to the statutory purpose; we may nevertheless consider any request on a case-by-case basis.
- Refunds are recorded in the financial records and reflected in public reporting.
7. Transparency
On the Transparency page we publish the amounts received, once verified, as well as funding commitments and expenditure. Pledges that have not been received are not counted as funds raised. We do not publish donors' names; sponsors may be acknowledged only with their agreement.
8. Personal data, changes and contact
How we process donors' data is described in the Privacy policy. We may update these terms; donations are governed by the version in force on the date they are made. For any question: contact@ivacaterina.org.
